RE : OUTCOME OF RECENT MEETING WITH SHAH ALAM SUBORDINATE COURT

Dear Members of the Bar,


In a recent Meeting with the Shah Alam Subordinate Court (Civil), the Court informed us that some lawyers do not appear to comply with directions. Consequently the Court requested the following could be adhered to:-

1. For cases where Courts have directed Written Submissions to be filed by way of e-filing, lawyers are reminded to e-file their Written Submissions. Please do not fax the Written Submissions or submit a hard copy to Court, unless directed by Court;

2. Lawyers who file their cases using the CD are to ensure their Notice Of Application and the Supporting Affidavit are in separate files in the CD. The same applies for Writ & Statement of Claim;

3. Some law firms filed the Writ without the Statement of Claim. Further some firms filed their Writ without signing them. Please ensure the Writ & Statement of Claim are both signed and both filed;

4. For Judgement In Default of Appearance, the filing fee is RM40 and NOT RM80. Some law firms are paying more;

5. For law firms requesting for refunds from Courts, apart from the reasons for refund, please attach the firm’s bank statement in relation to their request;

6. Law firms who do online filing are reminded to choose the document type carefully;

7. On amendments – do ensure the endorsement on the amendment is typed on the right hand corner of the Court document. Also do file the amendment within the time allowed by Court or by the rules;

8. For Judgment In Default of Appearance under Order 13 of the Rules Of Court, please file the Judgment In Default of Appearance in accordance with the Forms in the Rules of Court and it can be filed without the draft Judgment In Default of Appearance;

9. When filing the Judgment In Default Of Appearance, please do not date the judgment. The Courts will date it;

10. For Consent Judgment, there is no standard format. Courts will not reject the format drafted by lawyers for Consent Judgment;

11. For Fair Order, please file it promptly after receiving the Approved Draft Order from Court; and

12. The Pendaftar Kanan of the Shah Alam Magistrate Court Puan Norhayati has given her permission for us to inform members of her personal email. It is hasnor98@gmail.com If members have a problem with the extraction of documents at Shah Alam Magistrate Court, they can email the case number to her and she will look into the matter.
