Dear Members & Pupils of the Selangor Bar,

It has come to Selangor Bar Committee’s attention, The Star newspaper on 11.3.2021 had reported "Chambering Students acting as touts", wherein pupils in chambers have been alleged to have approached potential clients at various courts in Selangor at the behest of lawyers. The Selangor Bar Committee views such practice as objectionable.

If there are lawyers who have engaged pupils in chambers / touts / bogus lawyers to directly and/or indirectly approach and/or to obtain clients and/or potential clients, we would like to remind our Members of the following provisions: -

a) Section 15A of the Minor Offences Act 1955 states that any person who is guilty of touting, shall be guilty of an offence punishable with a fine or imprisonment or both; and

b) Rule 51 of the Legal Profession (Practice and Etiquette) Rules 1978 states that an advocate and solicitor shall not do or cause or allow to be done, anything for the purpose of touting directly or indirectly, or which is calculated to suggest that it is done for that purpose.

Pupils in chambers indulging in such acts are hereby put to notice that a show cause letter will be issued by the Selangor Bar Committee if in receipt of such a complaint.

Meanwhile, the Selangor Bar Committee will not hesitate to take all actions available against such touts, including the instructing lawyer and would like to advise members not to engage the services of touts in order to ensure that the integrity and dignity of the legal profession is preserved.
