Dear Members of the Bar,


We have received complaints from lawyers and the courts that there are touts appearing at the Court premises in Selangor on a regular basis.These touts were also seen to be present at the court premises during Remand Proceedings and seen approaching potential clients at the court premises.

It has been brought to our attention that some lawyers have even engaged attachment students to approach potential clients at the corridors of the courts in Klang, Ampang, Selayang and Petaling Jaya.

The Selangor Bar Committee views such practices as objectionable. Some of these attachment students even project themselves as lawyers to secure potential clients.

If there are any lawyers who have engaged Touts or Bogus lawyers and/or their Services to directly and/or indirectly approach and/or to obtain clients and/or potential clients, we would like to remind our Members of the following laws:-

a)Section 15A of the Minor Offences Act 1955 states that any person who is guilty of touting, shall be guilty of an offence punishable with a fine, imprisonment or both; and

b)Rule 51 of the Legal Profession (Practice and Etiquette)Rules 1978 states that an advocate and solicitor shall not do or cause or allow to be done, anything for the purpose of touting directly or indirectly, or which is calculated to suggest that it is done for that purpose.

Meanwhile,the Selangor Bar Committee will not hesitate to take whatever legal action available in law against such touts and would like to advise members not to engage the services of touts in order to ensure that the integrity and dignity of the legal profession is preserved.
